Terms of Service

1. Acceptance of Terms

By accessing or using NexioHost services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.

2. Description of Services

NexioHost provides hosting infrastructure including but not limited to Discord bot hosting, Lavalink server hosting, database hosting, Telegram bot hosting, and application hosting. Services are provided on a subscription basis as described in our pricing plans.

3. Account Registration

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• One person or entity may not maintain more than one account without prior approval

4. Acceptable Use

You agree not to use NexioHost services for:

• Any illegal activities or content that violates applicable laws
• Distribution of malware, viruses, or malicious code
• Cryptocurrency mining or resource-intensive background tasks not related to your hosted service
• Sending spam, phishing, or unsolicited bulk messages
• DDoS attacks or network abuse targeting any system
• Hosting content that infringes intellectual property rights
• Any activity that disrupts or degrades the service for other users
• Reselling services without written authorization

5. Resource Usage

Each plan has defined resource limits (RAM, CPU, storage). If your service consistently exceeds allocated resources, we may notify you to upgrade or optimize. We reserve the right to suspend services that negatively impact shared infrastructure.

6. Payment & Billing

• Services are billed on a recurring basis (monthly or as stated in your plan)
• Payment is due at the start of each billing cycle
• Failure to pay within 3 days of the due date may result in service suspension
• All prices are subject to change with 14 days advance notice

7. Service Availability

We target 99.9% uptime for all services. Scheduled maintenance will be announced in advance via our Discord server and status page. We are not liable for downtime caused by factors outside our control, including but not limited to upstream provider outages, natural disasters, or DDoS attacks beyond our mitigation capacity.

8. Data & Backups

While we maintain infrastructure-level redundancy, you are responsible for maintaining your own backups. NexioHost is not liable for data loss. We recommend implementing your own backup strategy for all critical data.

9. Termination

• You may cancel your service at any time through your client panel
• We may terminate or suspend services for Terms violations with or without notice
• Upon termination, your data will be deleted within 7 days unless otherwise required by law
• No refunds are provided for early termination unless covered by our Refund Policy

10. Limitation of Liability

NexioHost shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from the use or inability to use our Services. Our total liability shall not exceed the amount paid by you in the 3 months preceding the claim.

11. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of Nexio Host services shall first be attempted to be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration in accordance with the applicable arbitration rules. By using our services, you waive the right to participate in class-action lawsuits.

12. Modifications

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of Services after changes constitutes acceptance of the new Terms.
